Las presentes condiciones generales de contratación de servicios de matriculación se aplican a todas las contrataciones/matriculaciones efectuadas a través de la web https://www.examsandalucia.com. Toda contratación de servicios/matriculación implica necesariamente la aceptación sin reservas por el Cliente de los presentes Términos y Condiciones de contratación.

Por otro lado, LA PARTE CONTRATANTE/CANDIDATO.
Es el adquirente de los servicios comercializados por EXAMS ANDALUCÍA, en adelante

OBJETO DEL CONTRATO

El objeto del presente contrato es regular la contratación de los servicios de matriculación en los exámenes oficiales de Cambridge por EL CONTRATANTE/CANDIDATO, prestados por LA CONTRATADA. La misma se realizará de acuerdo al proceso y demás requisitos señalados en los puntos siguientes.

PRECIOS

Los precios publicados en la web son en euros. Los Precios se obtendrán una vez confirmados los datos solicitados por el programa.

MATRICULACIÓN

A) PROCESO DE MATRICULACIÓN

Para la matriculación en los exámenes oficiales de Cambridge a través de Exams Andalucía será necesario aceptar los presentes términos y condiciones que aparecen en el proceso de matriculación realizado a través de la web https://www.examsandalucia.com .
Para poder solicitar la inscripción en la realización del examen, primero deberá elegirse el nivel sobre el que quiere evaluarse el candidato.

Tras pulsar el botón “MATRÍCULATE AHORA” se le pedirá la siguiente información: Datos Personales (Nombre y Apellidos, DNI, Email, Sexo, teléfono de contacto, fecha de nacimiento), Tipo de preparación (Libre o a través de Centro Preparador Oficial), Población donde se examinará, tipo de examen (PaperBased o ComputerBased), tipo de certificación (Ket, Pet, First, etc.) y fecha en la que el candidato se examinará.

Posteriormente se le mostrará un resumen de los datos introducidos en el proceso de matriculación, así como el precio en euros de la realización del examen dependiente del tipo de nivel. Al final aparecerá un botón con la opción de “PAGAR”.
Por último, en una nueva ventana, deberá confirmar el pago a través del botón “CONFIRMAR”.

Una vez que se haya confirmado la matriculación en cualquiera de los exámenes de certificación de nivel, previo de pago, el candidato quedará formalmente inscrito para la realización de dicho examen.

B) CONDICIONES DE MATRICULACIÓN

1. El candidato acepta expresamente esta normativa.
2. El candidato se compromete a comunicar al centro de examen, dentro de los plazos estipulados, la solicitud de necesidades o requisitos especiales para la realización de las pruebas.
3. El candidato se compromete a seguir las instrucciones del personal examinador y aplicador de las pruebas y cumplir la normativa de examen de Cambridge English que figura en los documentos Resumen de la Normativa de Examen.
4. Antes de proceder con la matriculación, consulte las fechas previstas para el examen en los calendarios que figuran en nuestra página web o bien en la plantilla de matriculaciones; La fecha de “Speaking” (examen Oral) y la de los Escritos pueden ser diferentes; Es responsabilidad del candidato y de la academia que lo matricule estar informado de dichas fechas, así como de presentarse al examen en el lugar, el día y la hora correctos. Se enviará el “Confirmation of Entry” (Hoja de Candidato), a partir de los 8 días previos al examen, confirmando el horario y recordando las fechas de las dos partes del mismo. El día y hora fijados para el examen no se pueden cambiar.
5. Si no recibe el “Confirmation of Entry”, Hoja de Candidato, en el plazo indicado en el punto anterior, el interesado debe contactar inmediatamente con nuestro centro, no existiendo responsabilidad de este centro si este contacto no llega a realizarse.

6. Los datos utilizados para su matriculación serán los aportados por el candidato o su academia, por lo que cualquier error en la misma, no será nuestra responsabilidad.
7. Es obligatorio presentar alguno de estos documentos en vigor para la realización del examen:
   • DNI.
   • Pasaporte.
   • Carnet de conducir.
   • Permiso de residencia.
8. No se podrá anular la matrícula ni se devolverá el importe de las tasas de la misma, una vez finalizado el plazo de matriculación.
9. Una vez cerrado el plazo de matriculación, sólo se aceptarán cancelaciones presentando un documento que justifique la ausencia, solo por razones médicas. La cancelación tendrá un coste por gestión administrativa de 45 €, el cual será descontado de la cantidad a devolver.
10. Si se desea realizar la matriculación fuera del último día de matrícula, se dispondrá de un plazo extra de 4 días desde la fecha de cierre de convocatoria para abonar un recargo adicional (late entry fee) de 45 €. En el caso de matrículas de Young Learners (Starters, Movers y Flyers), el importe es de 25,00 €. Una vez pasado ese plazo, y sólo si las condiciones del examen lo permiten, la cantidad a abonar para matricular fuera de plazo será de 60 €. Si el examen, en este segundo plazo, no aparece en nuestra web, indicará que no es posible matricular más candidatos.
11. La Universidad de Cambridge ha establecido recientemente una nueva normativa que exige tomar una foto a todos los candidatos en exámenes oficiales. Estas fotografías no serán utilizadas para ningún otro uso distinto a la realización de los exámenes oficiales, y serán debidamente protegidas. La devolución de esta plantilla representa la prestación de su consentimiento para tomar dicha fotografía. No se tomarán fotografías en los casos de exámenes KET, PET, Young Learners ni tampoco en las convocatorias ForSchools.
12. No se permitirá la entrada al examen a los candidatos que lleguen tarde, si no es por causa de fuerza mayor, debidamente justificada.
13. Una vez realizados los exámenes, estos pasarán a ser propiedad de Cambridge English y no se devolverán.
14. Cambridge Assessment English se guarda el derecho a no publicar los resultados de los candidatos en los casos en los que haya evidencias claras de prácticas ilegales. Para más información, consúltelo a través de https://www.cambridgeenglish.org/help/malpractice/.
15. El candidato puede solicitar una revisión administrativa, la cual consta de dos fases (recuento y revisión), previo pago de una tasa a Cambridge English de 47 € para la primera y 116 € (A2-B1) ó 135 € (B2-C2) para la segunda fase.
16. Como aparece en el calendario de exámenes en las convocatorias con más de un día de Speaking, éste será asignado según número de candidatos. En ningún caso el candidato podrá escoger el día.
17. Los candidatos no podrán elegir a su pareja de Speaking.
18. Al efectuar la matrícula, el candidato acepta que sus datos personales sean trasmitidos electrónicamente a la Universidad de Cambridge.
19. Si requieres un examen adaptado por algún tipo de necesidad especial, debes comunicarlo antes de la fecha de cierre de matrícula a: info@examsandalucia.com
20. El candidato o Centro Preparador es responsable de formalizar la matrícula indicando el nombre y apellidos correctamente, tal cual aparece en su Documento Nacional de Identidad. En caso de no ser así, se podrán realizar las correcciones de nombres en los certificados, sin coste alguno para el candidato, durante los 6 primeros meses desde la fecha de la realización del examen. Pasados estos 6 meses, Cambridge Assessment establecerá un coste para realizar dicho cambio de nombre. Aproximadamente 60,00 €

JURISDICCIÓN

Las partes, con renuncia expresa al fuero que pudiera corresponderles, acuerdan someterse a los Juzgados y Tribunales de la ciudad de Granada para cualquier divergencia o conflicto que pudiera surgir en relación con la interpretación del presente Convenio.

On the other side, the CONTRACTING PARTY/CANDIDATE.
It is the party contracting services commercialized by EXAMS ANDALUCÍA.

SUBJECT OF CONTRACT

The subject of the present contract is to regulate the contracting of Cambridge official exam registration services by the CONTRACTING PARTY/CANDIDATE, supplied by the CONTRACTED PARTY. The registration will be conducted in accordance with the procedure and requirements stated below.

FEES

Our published fees on the website are in Euros. Fees will be displayed once the requested personal data has been confirmed by the application.

REGISTRATION

A) REGISTRATION PROCEDURE

To register for a Cambridge official exam with Exams Andalucía it is compulsory to accept the present Terms and Conditions stated in the online registration process through the website https://www.examsandalucia.com .
To register for an exam, it is first necessary to select the level the candidate would like to be examined at. After clicking on “MATRÍCULATE AHORA” (REGISTER NOW), the following information will be requested: Personal Details (Name and surname/s, ID number, Email address, Gender, Phone number, Date of Birth), Type of training (Self-study or through an Official Preparation Centre), City/town where the exam will take place, Type of exam (Paper Based or Digital), Type of Certificate (Ket, Pet, First, etc.) and date when the candidate will take the exam.  
Afterwards, a summary of the information provided in the registration process will be displayed, as well as the exam fee in Euros corresponding to the level selected. At the bottom of the page there will be a button with the option “PAGAR” (PAY).
Finally, a new window will open and payment will have to be confirmed by clicking the button “CONFIRMAR” (CONFIRM).
Once registration for any of the level certification exams is confirmed, upon payment of the exam fee, the candidate is formally enrolled to take the exam.

B) REGISTRATION CONDITIONS

1. The candidate specifically accepts the terms and conditions set out in this document.
2. Candidates must inform the Examination Centre – within the established deadlines – the special needs or requests that may be necessary for him/her to carry out the test.
3. The candidate promises to follow the instructions given by examiners and invigilators and to comply with the Cambridge English exam regulations included in the Exam Regulations Summary.
4. Before proceeding with registration, check the official dates provided on our web calendar. The dates of Speaking exams and written components might be different. It is the responsibility of the candidate and of the centre in charge of registering candidates to be aware of these dates and for the candidate(s) to turn up for the exam on the day, time and place specified in the Confirmation of Entry (COE). This document will be sent out from 8 days before the exam date and it will give the dates and of the time of each component of the examination. No changes can be made to the official date and time set for each part of the examination.
5. If the COE is not received in the timeframe indicated above, the candidate must contact Exams Andalucía immediately. Our centre will not be responsible if this contact is not made. If our phone line is busy please write to matriculascambridge@examsandalucia.com and/or to info@examsandalucia.com.
6. The information provided by the candidate or his/her centre will be reflected in the registration data, so any error derived from it will not be the responsibility of Exams Andalucía.
7. Candidates must provide an original, valid, current and not expired photographic ID (for example, passport or government issued identity card) at every part of the exam, otherwise they will not be allowed to sit the exam.
8. No registration may be cancelled nor will fees be refunded after the registration deadline.
9. After the registration closing date, cancellations will only be accepted with a doctor’s certificate. 45 € will be deducted from the refund as administrative expenses.
10. If you wish to register after the final day of registration, there will be an additional 4-day period from the closing date of the registration period to pay a late entry fee of 45€. For Young Learners registrations (Starters, Movers, and Flyers), the fee is 25.00€. After this period, and only if exam conditions allow it, the fee for late registration will be 60€. If the exam does not appear on our website during this second period, it will indicate that no further candidates can be registered.
11. Cambridge English language Assessment has recently been required to apply a new Government regulation that involves taking a photograph of all candidates in certain official exams. These photographs will have no use other than that required for official exams and they will be adequately protected. In the case of candidates under eighteen, sending this registration form implies your consent to this process. Photos will not be taken at KET, PET, YOUNG LEARNERS OR FOR SCHOOLS examinations.
12. Candidates who arrive late for any part of the exam will not be allowed into the examination room unless the late arrival has been caused by unavoidable circumstances which must be duly justified.
13. The completed exam becomes the property of the University of Cambridge English and cannot be returned.
14. Cambridge Assessment English reserves the right not to publish the results in those cases where there is evidence of Malpractice. For further information, please see https://www.cambridgeenglish.org/help/malpractice/.
15. The final result issued by the University of Cambridge English may be appealed in two stages (Clerical Check and Re-mark) upon payment of a revision fee (the Clerical Check is 47 € and the Re-mark is 116 € (A2-B1) or 135 € (B2-C2).
16. When according to the exams calendar, an examination has two Speaking dates, it is the number of candidates that will determine the date assigned. Under no circumstances may candidates choose the date.
17. Candidates may not choose who to be paired with for the Speaking exam.
18. By registering for a Cambridge official exam, candidates give their consent to have their personal data electronically sent to the University of Cambridge.
19. The candidate must inform the Examination Centre before the registration deadline of any special needs or requests that may be necessary for him/her to carry out the test.For further details (in English) please click here: https://www.cambridgeenglish.org/help/special-requirements/
20. The candidate or Preparation Centre is responsible for ensuring that the name and surname, as it appears on the candidate’s ID (DNI/Passport), is correct on registration. If not, any amendments required to certificates will be possible, up to 6 months after the written exam date without charge. After 6 months, Cambridge Assessment English will charge a fee of approximately 60€ to issue a new one.

JURISDICTION

The Parties hereby waive their own jurisdiction and any other jurisdiction that may correspond to them by law, and subject themselves to the jurisdiction of the judges and courts of the city of Granada in relation to any actions and claims that may arise from the interpretation of this Contract.
